Payment is due via wire transfer within 5 days of the winning bid being approved to GovDeals. Failure to make payment will result in a default of your buyer account.

•Buyer is responsible for all requirements set by transportation carrier contracted to move the purchased Equipment. • Buyer will have 10 days from the auction close date to make all necessary conditioning and remove Equipment from property. If the equipment is not picked up by the deadline, the buyer may be reported to GovDeals, issued a refund, and the item will no longer be available for purchase by the buyer. • Buyer will notify SCRRA at least 48 hours prior to Equipment being removed from SCRRA property
INDEMNITY
Buyer shall indemnify, defend and hold harmless the Authority, its member agencies and its directors, officials, contractors, agents, volunteers and employees from and against any and all liability and expenses including defense cost and legal fees and claims for damages of any nature whatsoever, including but not limited to bodily injury, death, personal injury or property damage arising out of the performance of the work hereunder, or by any negligent act or omission of the Buyer, and of the Buyer 's subcontractors, vendors or suppliers, anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable, except where caused by the sole negligence or willful misconduct of the Authority and its member agencies. The indemnity shall survive expiration, termination, or final payment of the auction. This indemnity is in addition to any other rights or remedies which the Authority may have under the law or under the auction terms.

Description Warranty: Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and a refund will be issued. The liability of the seller shall not exceed the actual purchase price of the property. Please note that upon removal of the property, all sales are final. Most items offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding. Bidders must adhere to the inspection dates and times indicated in the item description.
Payment: Payment in full is due not later than 5 business days from the time and date of the Buyers Certificate. Payment must be made electronically through the GovDeals Website. NO CASH, CHECKS, OR MONEY ORDERS WILL BE ACCEPTED!
How to make payment: Buyer must log into individual account and select "My Bids". Follow the instructions to complete payment.

Diesel Trucks & Buses:
An on-road heavy-duty diesel or alternative-diesel vehicle operated in California may be subject to the California Air Resources Board Regulation to Reduce Particulate Matter and Criteria Pollutant Emissions from In-Use Heavy-Duty Diesel Vehicles. It, therefore, could be subject to exhaust retrofit or accelerated turnover requirements to reduce emissions of air pollutants. All Passenger Vehicles:
This agency does NOT provide SMOG CERTIFICATION or EMISSIONS RETROFIT. All smog related repairs and certifications for vehicles are the sole responsibility of the buyer as outlined in California Vehicle Code, Division 12, Section 24007.5.
Heavy Equipment:
TITLE 13 CALIFORNIA CODE DISCLOSURE OF REGULATION APPLICABILITY: WHEN OPERATED IN CALIFORNIA ANY OFF-ROAD DIESEL VEHICLE MAY BE SUBJECT TO THE CALIFORNIA AIR RESOURCES BOARD IN-USE OFF-ROAD DIESEL VEHICLE REGULATION. IT THEREFORE COULD BE SUBJECT TO RETROFIT OR ACCELERATED TURNOVER REQUIREMENTS TO REDUCE EMISSIONS OF AIR POLLUTANTS.
