• All items offered for sale are used and may contain defects not immediately detectable.


• All bidders are HIGHLY encouraged to inspect the property prior to bidding.


• The auction items can be inspected during the hours of 8am - 3pm, Monday - Friday, CST during regularly scheduled work days.


• We are closed weekends and holidays.


• No appointment is needed to inspect auction items between these times.

WE WILL NOT SHIP ANY ITEMS!

• All property must be removed by appointment only and during our normal operating hours.

• All property must be removed within ten (10) business days from the time and date of issuance of the Buyer's Certificate.

• PRIOR TO THE REMOVAL OF ALL PROPERTY - The buyer or buyer's authorized representative must sign a Bill of Sale. The buyer is to complete and return a Auction Release Form provided by the Seller if he/she authorizes someone else to remove the property.

• SPECIAL INSTRUCTIONS FOR PICKING UP A VEHICLE - The bidder or his/her approved representative MUST obtain the signed vehicle title from the City Clerk of the City of Nixa @ 715 W. Mt. Vernon, Nixa MO. (East end of the Building) Please bring your I.D. Auction Release Form, and proof of payment with you. No title will be released without these. And no vehicles will be released without the Buyer providing the signed vehicle title to designated City Fleet Department staff. .

• The "Buyer" will make all arrangements and perform all work necessary, including packing, loading, and transportation of the property. No assistance will be provided.

• A daily storage fee of $10.00 may be charged to the "buyer" for any item(s) not removed within the 10 business days allowed and stated on the Buyer's Certificate.

• NOTICE - If you are the winning bidder and default by failing to adhere to this "sellers" terms and conditions your account with Liquidity Services WILL BE LOCKED.


• GUARANTY WAIVER - All property is offered for sale "AS IS, WHERE IS." the City of Nixa, Missouri "seller" makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.


• DESCRIPTION WARRANTY - "Seller" warrants to the "Buyer" that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If "Seller" confirms that the property does not conform to the description, "Seller" will keep the property and refund any money paid. The liability of the "seller" shall not exceed the actual purchase price of the property.


• Other defects not listed or mentioned may exist. It is YOUR RESPONSIBILITY to verify the functional ability of any item listed.
