REMOVAL (upon successful bid)

Removal is by appointment only and must occur within the three (3) business days listed above under “Removal Dates”, during posted operating hours. No appointments will be scheduled outside of these hours.

A fifteen (15) minute grace period applies to all removal appointments and begins at the scheduled time. Appointments may be cancelled if the Bidder does not arrive within the grace period.

The entire lot must be removed during the scheduled appointment. Buyers arriving outside the scheduled removal window will not be accommodated. Special removal accommodations, alternate pickup dates, or after-hours access will not be provided. Limited flexibility within posted operating hours may be granted at the County’s discretion.

Failure to comply with removal procedures may result in cancellation of the removal appointment and forfeiture of the property.

REMOVAL REQUIREMENTS

A paid invoice and valid identification matching the successful bidder’s name or their employees, agents, or representatives are required to be presented prior to removal of the property. The Bidder and/or their agents is/are solely responsible for all packing, loading, equipment, labor, and transportation.

Brazoria County employees or agents cannot assist with loading, lifting, dismantling, or transportation under any circumstances. The County does not provide supplies or equipment. Third-party pickups require written authorization and proof of insurance; at the time the pick-up appointment is scheduled.

If property is not removed within the required timeframe, ownership may revert to the County without refund.

LIMITED ON-SITE WORK – BATTERY REPLACEMENT OR JUMP START

Battery replacement or jump starting is permitted for vehicles and equipment solely for the purpose of loading and removal. This is limited to direct battery swaps and jump starts only. No additional mechanical work, dismantling, or repair is permitted. No equipment will be provided. All old batteries, tools, waste, or other equipment and supplies must be removed at the time of vehicle or equipment removal.

All such activity is performed at the Bidder’s sole risk. The County provides no tools, equipment, or assistance.

ENTRY AND REMOVAL AT SOLE RISK

Bidder agrees that it is entering onto Brazoria County property at its sole risk, knowledgeable of the inherent risks. The Bidder will make all arrangements and perform all work necessary, including packing, loading and transportation of the property, and accepts all risk and responsibility for injury or damages associated with these actions.

Under no circumstances will Brazoria County assume responsibility for packing, loading or shipping, and Bidder agrees that Brazoria County will not be liable for any injury or damages associated with the above.

INDEMNITY & WAIVER

Bidder shall protect, defend, forever discharge, release, waive, indemnify and hold Brazoria County and the auctioneer and/or auction platform provider, and their respective affiliates, officers, directors, employees, agents, shareholders, and insurers (“Indemnified Parties” or “Indemnified Party”) harmless from and against any and all losses, liabilities, expenses (including all attorney’s fees and costs incurred by any identified party related to any claim or loss as well as any attorney’s fees and costs incurred in the enforcement of this agreement), claims and causes of action for damages of any kind or nature (whether in tort, contract, law or equity), for personal injury or death, property damage or loss by whomsoever made and howsoever arising in connection with or related to: (i) the Bidder’s presence at Brazoria County property; (ii) the public online auction; or (iii) arising out of the possession, ownership, or use of any property or merchandise purchased at the auction.

WITHOUT LIMITING THE FOREGOING, THIS AGREEMENT SHALL COVER ANY LOSS, LIABILITY, EXPENSE, CLAIM OR CAUSE OF ACTION ARISING IN WHOLE OR IN PART, FROM THE ACT, OMISSION, FAULT, NEGLIGENCE, STRICT LIABILITY, OR BREACH OF CONTRACT OF ANY OF THE IDENTIFIED PARTIES, WHETHER SUCH CLAIM IS KNOWN OR UNKNOWN.

DISCLAIMER OF WARRANTIES

Notwithstanding anything contained to the contrary in this Agreement, none of the Indemnified Parties is making any representation or warranty whatsoever, express, implied, statutory or otherwise, and it is understood that the Bidder takes any property purchased from Brazoria County AS IS AND WHERE IS.

ENTIRE AGREEMENT

This Agreement constitutes the entire understanding regarding auction participation and property removal.
