Bidder should visit the site and become familiar with the conditions of the offered areas, including the nature of the equipment required, the obstacles which may be encountered and the work to be performed, etc. TSCC will not provide any equipment, labor, materials, etc.
Any and all machinery required for mowing, raking, baling, etc is allowed to remain on the property no more than 7 days. If a longer period of time is needed due to weather, etc, permission must be granted by the Facility Operations Director. All hay bales must be removed within 20 days of baling. TSCC is not responsible for any of the bidders equipment, machinery, bales, etc.
This auction is for only the opportunity to harvest hay in identified areas. No other agriculture (or other) work or purpose is allowed. Additionally, no spraying of any kind is allowed except for preservative or inoculant applicators on/in the baler chamber.
All bidders are required to have Commercial General Liability insurance of not less than $1,000,000.00. Haying operations are not allowed during major campus events. The winning bidder is responsible to coordinate operations prior to commencing. The winning bidder shall use care and caution while performing the work and shall notify the Facility Operations Director within 24 hours of any damage sustained to the property and shall repair or compensate TSCC for any damage.
TSCC will provide known utility info, if any, in the selected areas.
Again, "Property rights are offered AS-IS. Successful bidder should inspect all locations prior to bidding. Terra State Community College makes no guarantee regarding acreage, hay quality, yield, forage species, or harvest quantity. Successful bidder assumes all risks associated with harvesting operations."
Indemnity Agreement: The Operator/winning bidder agrees to protect, indemnify and save harmless Terra State Community College and the Terra State Community College employees and agents from and against all causes of action, claims, demands, suits, liability or expense by reason of loss or damage to any property or bodily injury to any person, including death, as a direct or indirect result of operations under this Agreement or in connection with any action or omission of the Operator, who shall defend the Owners and the Owners’ employees and agents in any cause of action or suit.

Payment
Payment in full is due not later than five (5) business days from the time and date of the Buyer's Certificate. Payment must be made electronically through the GovDeals Website. Payment Methods are listed above.
TAX EXEMPTION: Where taxes are applicable (see the Buyer's Certificate), Tax Exempt documents must be provided to this seller within 24 hours of the auctions close and before payment is made. Please see the contact below for any questions.
Removal
The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. No Assistance will be provided. A daily storage fee of $10.00 may be charged for any item not removed within the 10 business days allowed and stated on the Buyer's Certificate.

Guaranty Waiver. All property is offered for sale 'AS IS, WHERE IS.' Terra State Community College, OH makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.
Description Warranty. Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.
