Inspection: Most items offered for sale are used and may contain defects not immediately detectable. Bidders may inspect the property prior to bidding. • Property may be removed by Appointment Only and Appointments must be made at least 24-hours in advance.
• Before Assets are Released, the winning Buyer must present a Copy of the winning Buyer's Certificate and a Copy of their Driver's License for Identification.
• All items must be removed within Ten (10) Business Days from the Date and Time of Issuance of the Buyer's Certificate.
• The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property.
• Under no circumstances will Seller assume responsibility for packing, loading, or shipping assets. No Assistance will be provided.
• A Daily Storage Fee of $10.00 may be Charged for any item not Removed within the 10-Business Days allowed and stated on the Buyer's Certificate.
• Property may be Removed between the Hours of 9:00 a.m. and 3:00 p.m., Monday through Friday, excluding Legal Holidays.
• All Assets must be Removed from the Location by the Buyer; the City of Albemarle will not Ship Assets.

NOTICE: If you are the winning bidder and default by failing to adhere to this sellers terms and conditions your account with Liquidity Services WILL BE LOCKED.

Guaranty Waiver: . All property is offered for sale “AS IS, WHERE IS.” (Seller) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.

Description Warranty: Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for an incorrect description must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.

Restricted Buyers: The following City of Albemarle Staff Members are restricted from purchasing surplus items, due to conflict-of-interest concerns:

· City Councilmembers

· City Manager

· Assistant City Manager

· Finance Director

· Purchasing Coordinator

· Requesting Employee in the Department

· Requesting Department Manager and/or Supervisor Signing the Disposal Form

· Maintenance Staff who Service Vehicles that are included in a surplus auction

· Other staff members, not specifically mentioned herein, that are involved in the

administration of the surplus auction.

· Spouses of all restricted purchasers detailed above (see NCGS § 14-234)

City of Albemarle Employees may bid on and purchase surplus City property under the same rules as the general public, but neither while on duty; nor, if a party listed above.
