SALES TAX

Guaranty Waiver: . All property is offered for sale “AS IS, WHERE IS.” (Seller) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. Please note that upon removal of the property, all sales are final.
Description Warranty: Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for an incorrect description must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property.
Restricted Buyers: The following City of Albemarle Staff Members are restricted from purchasing surplus items, due to conflict-of-interest concerns:
· City Councilmembers
· City Manager
· Assistant City Manager
· Finance Director
· Purchasing Coordinator
· Requesting Employee in the Department
· Requesting Department Manager and/or Supervisor Signing the Disposal Form
· Maintenance Staff who Service Vehicles that are included in a surplus auction
· Other staff members, not specifically mentioned herein, that are involved in the
administration of the surplus auction.
· Spouses of all restricted purchasers detailed above (see NCGS § 14-234)
City of Albemarle Employees may bid on and purchase surplus City property under the same rules as the general public, but neither while on duty; nor, if a party listed above.
