Any use of the term, “WaterOne,” in this contract refers to Water District No. 1 of Johnson County and any and all agents, employees and representatives. This contract is to serve as a notice to the Buyer that he: 1) is willingly and knowingly requesting the assistance of WaterOne in the loading of purchased item(s); and 2) is willingly and knowingly accepting all liability and responsibility for any damage or loss to person or property, resulting from the loading activities. It is an express condition of this contract that the Buyer must assume all responsibility and liability for any damage or loss to person and property and agree to not hold WaterOne liable for injuries or damages. It is further expressly provided that the Buyer must manifest his intent to accept this waiver of liability by carefully reading this contract, signing his name in the appropriate space below, and ascribing today’s date before WaterOne will assist him. The Buyers performance of the reading, signing and dating of this contract will serve as a manifestation of his express agreement to its terms and his good faith intent to abide by them, and only upon completion of that performance will WaterOne assist him. Furthermore, this contract reaffirms all other provisions and agreements in the GovDeals.com “Online Sales- Terms and Conditions.” WaterOne reserves the right to refuse to assist any Buyer in loading activities for any reason. Furthermore, WaterOne’ s practice of assisting some Buyers in no way obligates it to assist all Buyers, and it may refuse to do so without providing a reason. Buyer agrees to defend, indemnify and hold WaterOne, its officers, agents and employees, harmless and keep WaterOne free from any and all costs, including attorneys’ fees, expenses, damages, suits, judgements, liabilities and claims for damage arising out of or in any way resulting from WaterOne’ s assistance in loading activities.

All property is offered for sale "AS IS, WHERE IS". Water District Number One of Johnson County (WaterOne) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale. All items must be removed within 10 business days from the time and date of issuance of the Buyer's Certificate. The Buyer will make all arrangements and perform all work necessary, including packing, loading and transportation of the property. Property may be removed between the hours of 9:00AM to 3:00PM, Monday through Friday, excluding legal holidays. Prior to removal, the buyer or buyer's authorized representative must sign a Bill of Sale. The buyer is to complete the Auction Release Form provided by the Seller if he/she authorizes someone else to remove the property. See special instructions on each auction page for removal details. A daily storage fee of $10.00 may be charged for any item not removed within the 10 business days allowed and stated on the Buyer’s Certificate.

TAX EXEMPTION: Tax exempt documents must be provided to this seller within 24 hours of the auctions close.
