Buyer Removal, Disassembly, and Site Restoration Requirements

1. Buyer Responsibilities
The buyer is solely responsible for all disassembly, demolition, removal, and transportation of the carport structure. This includes:
- Complete takedown/disassembly of the carport
- Safe removal of all structural components from the site
- Demolition and removal of the existing shed located beneath or adjacent to the carport (if applicable)
- Removal of all debris, materials, and waste created during disassembly or demolition
- Full restoration and cleanup of the area prior to departure

2. No Seller Assistance
The City of Durham will not provide labor, equipment, tools, electrical disconnects, demolition assistance, or loading services.
All work, equipment, and arrangements required to complete removal must be provided by the buyer.

3. Damage Liability
The buyer is responsible for any damage to City property or surrounding structures that occurs during removal activities.
Repairs, if required, must be completed at the buyer’s expense and to the City’s satisfaction.

4. Compliance Requirements
Buyers must:

- Follow all applicable OSHA, safety, and local building regulations
- Ensure all workers are properly insured and qualified
- Complete all removal and cleanup no later than the deadline stated on the Buyer’s Certificate

5. Inspection and Access
Buyers must schedule removal appointments in advance.
The City reserves the right to inspect the site following removal to confirm compliance.

As‑Is, Where‑Is Structural Removal Disclaimer:
The buyer acknowledges that the carport structure and associated shed are sold as‑is, where‑is. The seller does not warrant structural integrity, material condition, or suitability for relocation. The buyer assumes all risks associated with disassembly, removal, and transportation.

The buyer must remove this carport no later than Friday, March 20th as the City will be demolishing the Wheels Fun House building and all associated structures.

Removal

Removal: REMOVAL IS BY APPOINTMENT ONLY. WINNING BIDDER MUST CONTACT Katrina Bishop at katrina.bishop@durhamnc.gov to schedule removal. Once payment has been made, directions will be given regarding removal. All items must be removed within 10 business days from the time and date of issuance of the Buyer’s Certificate. Removal must be performed between the hours of 9:00 a.m. and 3:00 p.m., Monday through Friday. Purchases will be released only upon receipt of payment as specified.

Special Instructions

All bidders and other participants of this auction agree that they have read and fully understand these terms and agree to be bound thereby. If you are the winning bidder and default by failing to adhere to this sellers terms and conditions your account with Liquidity Services WILL BE LOCKED.

Guaranty Waiver. All property is offered for sale “AS IS, WHERE IS.” (Seller) makes no warranty, guaranty or representation of any kind, expressed or implied, as to the merchantability or fitness for any purpose of the property offered for sale.

Description Warrant: Seller warrants to the Buyer that the property offered for sale will conform to its description. Any claim for misdescription must be made prior to removal of the property. If Seller confirms that the property does not conform to the description, Seller will keep the property and refund any money paid. The liability of the seller shall not exceed the actual purchase price of the property. Please note that upon removal of the property, all sales are final.
