Locomotive is located in North County Transit District (NCTD) Stuart Mesa Maintenance Facility on Marine Corps Base Camp Pendleton in Oceanside, CA. Buyer is responsible for securing access to Camp Pendleton through the Marine Corps Base Camp Pendleton’s Base Control Access Branch (“BCAB”). The BCAB makes the ultimate decision to grant or deny base access and NCTD should be held harmless if access is denied.
To obtain NCTD base access sponsorship, and email must be sent to administration@nctd.org within ten (10) business days of the auction close with the following information:
a) The name of attendee(s) requiring base access;
b) The two-letter abbreviation of the State or Province where the attendee’s Driver License/Identification Card/Passport was issued (whichever is going to be used for identification purposes);
c) The Driver License/ID Number/Passport Number for the attendee(s) (inclusive of hyphens or other punctuations); and
d) The date and time when the locomotive will be picked up.
NCTD Administrative staff will contact the buyer with instructions for applying for the base pass after the information above is received. Buyer has thirty (30) calendar days from the close of auction to pick-up the locomotive.
All shipping and handling costs, including but not limited to labor costs, handling, transportation, packaging, and insurance, are to be covered 100% by the Buyer. Buyer is responsible for securing the transportation to remove the locomotive. The Buyer takes ownership and all related responsibility of the locomotive upon removal from NCTD’s Stuart Mesa Rail Maintenance Facility and NCTD shall be fully relieved of any liability related to the use, access, or transport of the locomotive. Locomotive is sold “as-is” and NCTD makes no representations or express and/or implied warranties of any kind, including as to the condition or performance of the locomotive.
The buyer will defend, indemnify and hold NCTD, its Board of Directors, officers, employees, consultants, contractors and agents harmless from any and all liability, loss, expense (including reasonable attorneys’ fees and other defense costs), demands, suits, liens, damages, costs, claims, including but not limited to, claims for bodily injury, death, personal injury, or property damage arising from or connected with this auction.
This auction shall be interpreted in accordance with the laws of the State of California. If any action is brought to interpret or enforce any term of this auction, the action shall be brought in a state or federal court situated in the County of San Diego, State of California.
