SPECIAL TERM AND CONDITION: At the request of the highest qualified bidder, DCAS may waive base rent payment for up to six calendar months from commencement date. Tenant acknowledges that during the base rent concession period, tenant’s use of the premises shall be for the sole and exclusive purpose of conducting architectural, engineering, and construction work of a nonstructural nature to prepare the premises for occupancy pursuant to the lease.

To bid at the auction, a bid deposit of $2,500 (refundable per the Terms and Conditions) will be required via wire transfer. Wire transfers must be submitted by Thursday September 25, 2025 at 5pm. The Bid Deposit is refundable after the auction closes and the Apparent Highest Bidder has been posted on nyc.gov/realestateauctions.

Prospective bidders are advised that at the time of bidding, this property may be occupied on a month-to-month basis. However, the property will be vacated and a lease will be delivered to the highest qualified bidder within sixty (60) days of the auction or said bidder will have the option of withdrawing its bid without penalty any time thereafter and all funds held by DCAS on account will be promptly returned to said bidder. If said bidder elects to not withdraw its bid after the initial sixty (60) day period, DCAS will continue to make good faith efforts to obtain exclusive possession of the property in order to deliver a lease.

Prospective bidders are advised that pursuant to Article 4B of the proposed lease, Tenant’s use of the Premises shall be in complete conformity with the Certificate of Occupancy and any other applicable laws, rules and regulations. However, prospective bidders are further advised that the tenant may not make any changes or modifications to the Certificate of Occupancy.
