Description

All that certain parcel of land situate in Cradock, in the City of Portsmouth, Virginia, and bounded and described as follows: Beginning at a point on the southern side of Afton Parkway, which point is 32.90 feet in a westerly direction from the southwestern corner of the intersection of Afton Parkway and Ericsson Street and which point is the center line of a common wall dividing the property herein conveyed and property conveyed to Curtis W. Gent, et ux, as recorded in Deed Book 915, page 634 in the Clerk’s Office of the Circuit Court of Portsmouth, Virginia; thence from said point running in a southerly direction along the center line of the said common wall a distance of 30.63 feet, more or less, to the center line of a common wall dividing the property herein conveyed and property known as “Afton Theatre”; thence running in a westerly direction along the center line of said common wall a distance of 64.54 feet, more or less, to the center line of a common wall, which common wall divides the westerly boundary of the property herein conveyed and the “Lobby” area of property known as “Afton Theatre”; thence in a northerly direction along the center line of said common wall a distance of 30.60 feet, more or less, to the southerly side of Afton Parkway; thence along the southerly side of Afton Parkway in an easterly direction a distance of 64.54 feet, more or less, to the point of beginning.

It being the same property conveyed to Kenneth W. Whitley, Sr. and Janette R. Whitley by deed from Richard L. Elrod, Charles E. Ridenhour, and Janette R. Whitley dated January 18, 1990 and recorded in the Clerk’s Office of the City of Portsmouth in Deed Book 1037 at page 1132.

This auction has a view only time frame from May 19, 2026, starting at 8:00 am, through May 26, 2026, at 10:59 am. No bidding will occur during this time.
Bid deposits will only be accepted from May19, 2026 through May 27, 2026.
Bidding will be open from May 26, 2026, starting at 11:00 am through May 29, 2026, ending at 2:00 pm (please note: the auction ending time will extend beyond 2:00 pm, known as “auto-extension”, if a bid is placed within the final 3 minutes. The auto-extension will stop adding time when no bids are received for a 3-minute time frame).

To be eligible for bidding, there are three requirements:

(2)Submit a bid deposit. You will find the bid deposit instruction form below under the 'Attachments' section of this auction. If you do not see the link, click on "show more items." Bid deposits are not instant and can take one full day or longer to transfer from bank to bank; therefore, we encourage you to plan accordingly. If you wait until the last day to submit your bid deposit, you run the risk of your deposit not being cleared in time for you to bid.
(3)Subscribe to the Portsmouth Real Estate, VA tier. Requesting tier access allows us to verify your bid deposit and subsequently approve you for bidding. Click on "Register to Bid" in the blue bar to the right of the pictures. On the next page, click on "Apply Now." Your status will remain in “Pending” until bidding is open.

    As a judicial sale, there is no closing. If the Circuit Court approves the highest bid and confirms the sale, then the Special Commissioner simply executes a special warranty deed to the successful high bidder in accordance with the Court's order. The fees and costs associated with the judicial sales process are paid from the auction proceeds. If you want to pursue title insurance or have other traditional closing needs, then you would be responsible for those costs to whomever provides those services. 05/01/2025 15:26:30 PM

Payment

The Buyer's Certificate will contain information to schedule payment & removal.

TAX EXEMPTION: Where taxes are applicable (see the Buyer's Certificate), Tax Exempt documents must be provided to this seller within 24 hours of the auctions close and before payment is made. Please use the 'Ask a Question' feature for all questions.

Payment in full is due not later than five (5) business days from the time and date of the close of the auction. INSTRUCTIONS (Total costs = Amount of the winning bid + 5.25% of the winning bid (Admin Fee) + recording fees + transfer taxes, etc.). THIS EMAIL WILL BE IN ADDITION TO THE BUYER'S CERTIFICATE FROM GOVDEALS. Acceptable forms of payment are: U. S. Currency, Certified Cashiers Check, Money Order, or a Company Check (with Bank Letter guaranteeing funds - mandatory).

Removal

The successful high bidder must pay the remaining balance of the high bid, the administrative fee of 5.25%, and the recording costs within ten days of the completion of the auction. Title to the property will be conveyed be special warranty deed following the confirmation of the judicial sale by the Court. Real Estate Taxes are prorated as of the sale date.

Guaranty Waiver. All property is offered for sale 'AS IS, WHERE IS.' Portsmouth - Real Estate, VA makes no warranty, guaranty or representation of any kind, expressed or implied,. Please note that upon removal of the property, all sales are final.

Description Warranty. In the event that the winning bidder default in the full payment of the purchase price, the administrative fee of 5.25%, and the recording costs, then the seller will forfeit the buyer's down payment of 20% and apply those funds to the costs of the auction and the seller shall retain all legal remedies available at law against the defaulting purchaser.
