Inspection
BUYER RESPONSIBILITY - Buyers shall, at their sole cost and discretion, perform all due diligence prior to submitting any bid. This includes but is not limited to on-site physical inspections, independent surveys, thorough title examination, review of applicable laws, regulations, zoning ordinances, encroachments, easements, and all relevant legal agreements. Any omission or failure to conduct such due diligence does not constitute a warranty or representation by the Seller, MDC, or associated parties. "AS IS, WHERE IS” CONDITION - The property is offered strictly on an “as is, where is” basis, with all faults. No warranties—express or implied—are provided. Prospective bidders are strongly encouraged to engage professionals (e.g., engineers, surveyors, attorneys) to verify all material facts. INSPECTION SCHEDULING – Inspections are available by appointment only. To schedule a site inspection, use the “Ask a Question” feature. Public access may occur during designated on-site hours, subject to posted notices and prior arrangement. BOUNDARY CONFIRMATION - Maps and other visual aids are for reference only and are not guaranteed accuracy. Maps, photographs, and additional reference materials are included in the attachments. Payment
RESERVE PRICE - The winning bidder must be approved by Seller, MDC. The reserve price is confidential and will NOT be disclosed. AUCTION WINNING BIDDER - The successful bidder must remit a 5% Buyer Service Fee (BSF) to GovDeals via wire transfer within five (5) business days of auction close. This fee is separate from and in addition to the purchase price. The purchase price shall be paid in full at closing. The Title Company and Seller will collaborate to provide the winning bidder with detailed payment instructions. Closing costs shall be shared equally (50/50) between the winning bidder and the Seller. The closing will take place at a licensed local title company, mutually selected by Buyer and Seller. The exact closing date will be coordinated directly between Buyer and Seller. Optional transaction-related expenses — such as a survey and inspection costs — are not included in the split and shall be borne entirely by the winning bidder. TAXES - Buyer will be responsible for any property taxes (though currently there are no assessments). Prospective Buyers should contact the County Assessor for an estimation.
Removal
CONVEYANCE AND SALE AS IS - Each parcel is offered “AS IS, WHERE IS”. The Conservation Commission of Missouri (“Seller”) makes no warranties or representations, express or implied, as to the condition, acreage, boundary accuracy, access rights, zoning, title status, environmental condition, encroachments, or any other matter related to the tract. Buyers acknowledge and accept all existing conditions, defects, and faults. The Seller will not undertake or fund any modifications, repairs, or improvements to the tract. No future use restrictions are placed on the property by the Seller. Upon conveyance, all sales are final, and no refunds or allowances will be issued, except as provided under the Description Warranty below. DESCRIPTION WARRANTY LIMITED - The Seller warrants only that each parcel will materially conform to its online description and any supporting documentation. Any claim for misdescription must be submitted in writing prior to conveyance — i.e., before title transfer or payment of purchase price processing. Upon Seller’s verification, the remedy will be limited either to: 1. Refund of the 5% Buyer Service fee (BFS) through GovDeals customer service, and termination of the sale 2. Proceed with the sale while allowing a mutually agreed-upon timeframe for either party to review, correct, or adjust the terms.
Special Instructions
DEFAULT AND ACCOUNT SUSPENSION - By placing a bid, you acknowledge and agree that if you are the successful bidder but fail to comply with the Seller’s terms and conditions—including timely payment and conveyance of the land tract—your account with Liquidity Services (GovDeals) will be suspended or terminated.
